AMALFIDUO™ IS OPERATED BY BEMEDIQ LLC AND PROVIDES TECHNOLOGY, ADMINISTRATIVE, AND COORDINATION SERVICES THAT ENABLE ACCESS TO INDEPENDENT HEALTHCARE PROVIDERS. AMALFIDUO DOES NOT PRACTICE MEDICINE, MAKE CLINICAL DECISIONS, PRESCRIBE MEDICATIONS, OPERATE A PHARMACY, OR DISPENSE OR SHIP MEDICATIONS.
MEDICAL SERVICES ARE PROVIDED BY LICENSED, INDEPENDENT HEALTHCARE PROFESSIONALS PRACTICING THROUGH BELUGA HEALTH, P.A. PHARMACY SERVICES ARE PROVIDED BY INDEPENDENT, LICENSED DISPENSING PHARMACIES.
THE SERVICES MAY NOT BE APPROPRIATE FOR EVERY MEDICAL CONDITION OR CONCERN.

Please read these Terms of Service carefully. They contain important information about your legal rights and responsibilities.
By accessing or using the AmalfiDuo website, patient portal, applications, or services, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree, do not access or use the Sites or Services.
AmalfiDuo is a brand and d/b/a of BeMediq LLC. In these Terms, “AmalfiDuo,” “we,” “our,” and “us” refer to BeMediq LLC doing business as AmalfiDuo.
AmalfiDuo owns or operates the AmalfiDuo website and associated patient-facing applications, portals, and digital services, collectively referred to as the “Sites.”
The Sites facilitate access to services for registered users, collectively referred to as the “Services,” which may include:
- Information concerning sexual wellness and related treatment options;
- Secure online health questionnaires and intake processes;
- Technology and administrative support for telehealth services;
- Communications between patients and licensed healthcare professionals;
- Scheduling, payment, account, and refill-management services;
- Coordination of prescriptions with independent licensed pharmacies;
- Order, delivery, and customer-support communications; and
- Educational and nonclinical information.
Technology and administrative services are supported through the Nexu Health platform.
Medical services are provided independently by licensed healthcare professionals practicing through Beluga Health, P.A. AmalfiDuo does not control or interfere with a provider’s clinical judgment.
Pharmacy services are provided by independent licensed pharmacies. AmalfiDuo is not a pharmacy and does not compound, manufacture, dispense, package, or ship medication.
The Services are available only in U.S. states where the applicable medical providers, pharmacies, and service arrangements are authorized to operate.
Availability may vary based on:
- Your physical location;
- Provider licensure;Pharmacy licensure and service area;
- Clinical eligibility;
- The treatment requested;
- Applicable laws and regulations; and
- Operational or supply limitations.
A product or service displayed on the Sites may not be available in every state or to every patient.
To use the Services, you must:
- Be at least 18 years old;
- Be physically located in a state where the requested Services are available;
- Have the legal capacity to enter into these Terms;
- Provide complete, current, and accurate information;
- Use the Services only for yourself unless you are legally authorized to act for another person; and
- Agree to comply with these Terms and all incorporated policies and consents.
Meeting these requirements does not guarantee that you will receive medical care, a prescription, medication, or a particular treatment.
A licensed provider will determine whether telehealth is appropriate and whether any requested treatment is medically appropriate. AmalfiDuo, Beluga Health, participating providers, and dispensing pharmacies may establish additional eligibility or verification requirements when reasonably necessary.
You are responsible for having:
- A compatible computer, telephone, tablet, or other internet-enabled device;
- Reliable internet or mobile-network access;A current browser or compatible software;
- A valid email address and telephone number; and
- Any other technology necessary to access the Services.
Your internet, telephone, text-message, and data-provider charges are your responsibility.
The availability and performance of the Services may be affected by your device, software, internet connection, mobile carrier, or other systems outside AmalfiDuo’s control.
Telehealth involves the provision of healthcare services using electronic communications and information technology when the patient and healthcare professional are in different locations.
Telehealth services may include:Secure online questionnaires;Electronic transmission of medical and health information;Asynchronous messaging;
Telephone or video communications when required;
- Chart review;Remote prescribing;
- Follow-up communications; and
- Electronic transmission of prescriptions and related records.
Before receiving medical services, you must review and agree to the Beluga Health Informed Consent for Telehealth Services.
The current Beluga Health Informed Consent for Telehealth Services is incorporated into these Terms by reference. If there is a conflict between these Terms and the Beluga consent concerning the provision of medical services, the Beluga consent controls with respect to those medical services.
You may be asked to confirm your identity, physical location, and consent before or during a telehealth encounter.
AmalfiDuo recognizes that information concerning sexual health, medications, relationships, and treatment interests is sensitive.
Your information is handled according to the policies applicable to the organization that receives and maintains it, which may include:
- The AmalfiDuo Privacy Policy;
- The AmalfiDuo Consumer Health Data Privacy Policy;
- The applicable Beluga Consent to Telehealth
- Medication Safety Information.
These policies are incorporated into these Terms by reference where applicable.
Protected health information maintained by a covered healthcare provider, pharmacy, or business associate is subject to applicable HIPAA requirements. Telehealth providers subject to HIPAA must use technology and arrangements that satisfy applicable privacy and security requirements.
No electronic system is completely secure. You are responsible for using reasonable safeguards, including protecting your password, securing your device, and avoiding the use of public or unsecured networks when accessing sensitive information.
AmalfiDuo is not a healthcare provider and does not provide medical advice, diagnosis, or treatment.
AmalfiDuo provides consumer-facing technology, administrative support, payment coordination, and access to independent healthcare professionals.
When you receive medical services, your provider-patient relationship is with the licensed healthcare professional and the professional medical entity through which that professional practices—not with AmalfiDuo or BeMediq LLC.
Providers are solely responsible for:
- Evaluating your health information;
- Determining whether telehealth is appropriate;
- Making diagnoses;Recommending or declining treatment;
- Prescribing medication when medically appropriate;
- Providing clinical instructions;Monitoring treatment; and
- Determining whether follow-up or in-person care is necessary.
AmalfiDuo does not direct a provider to prescribe any medication and does not guarantee that a provider will approve your requested treatment.
You must provide complete, current, and accurate information concerning your:Identity and date of birth;
- Physical location;
- Medical history;
- Diagnoses and prior treatments;
- Current prescription and nonprescription medications;
- Vitamins and supplements;
- Allergies;Relevant alcohol or substance use;
- Pregnancy or breastfeeding status where applicable;
- Symptoms and treatment goals; and
- Changes in your health after treatment begins.
A provider may not have access to your complete medical record or the information normally obtained during an in-person physical examination.
Incomplete, inaccurate, or misleading information can result in inappropriate treatment, adverse reactions, drug interactions, delayed care, or denial of Services.
You must promptly inform your provider if your health, medication use, symptoms, or other relevant circumstances change.
Submitting an intake questionnaire, creating an account, selecting a product, entering payment information, or previously receiving treatment does not guarantee:
- Acceptance as a patient;
- Completion of a telehealth consultation;
- A diagnosis;A prescription;
- Approval of a particular medication or dose;
- Continued treatment;
- A refill; or
- Any particular result.
All clinical decisions are made solely by the licensed provider using independent professional judgment.
A provider may request additional information, require a telephone or video consultation, recommend in-person care, prescribe a different treatment, delay treatment, or decline treatment.
By creating an account or using the Services, you agree that AmalfiDuo, Beluga Health, participating providers, Nexu Health, pharmacies, payment processors, delivery providers, and authorized service providers may send communications reasonably related to your account or requested Services.
These may include:
- Account-verification messages;
- Intake and consultation notices;
- Provider messages;Requests for additional information;
- Prescription and treatment updates;
- Payment and receipt notifications;
- Refill reminders;
- Pharmacy and shipping updates;
- Safety notices; and
- Customer-support communications.
It is your responsibility to monitor these communications and keep your email address and telephone number current.
AmalfiDuo is not responsible for harm caused by your failure to read a communication, respond to a provider request, follow treatment instructions, or update your contact information, except where responsibility cannot legally be limited.
By providing your telephone number or initiating text-message communications, you consent to receive transactional calls and text messages related to your account and Services.
Messages may be sent using automated technology. Message and data rates may apply. Message frequency varies.
Consent to receive promotional or marketing text messages is not a condition of purchasing or receiving Services. Where marketing consent is requested, it will be obtained separately where required.
You may opt out of promotional text messages by replying STOP. You may receive one final message confirming your opt-out. Opting out of promotional messages may not stop communications necessary to provide requested medical, account, pharmacy, safety, or transactional services where permitted by law.
Email and ordinary SMS communications may not be encrypted. Sensitive information should be communicated through the secure patient portal or another approved secure channel whenever available.
By choosing to communicate through ordinary email or text message, you acknowledge the risk that information may be accessed by someone with access to your device, account, telephone number, or communications network.
A provider evaluating you through telehealth may not have the information that would be available through an in-person physical examination, diagnostic testing, or access to your complete medical records.
By using the Services, you acknowledge that:
- A telehealth evaluation has limitations;
- A diagnosis may be limited or provisional;
- Telehealth does not replace in-person care in every situation;
- Additional testing or examination may be necessary;
- A provider may refer you to another healthcare professional;
- The absence of a physical examination may affect diagnosis or treatment; and
- Some conditions cannot be evaluated or treated safely through telehealth.
You should maintain a relationship with a primary care provider for your general and ongoing healthcare needs.
Except for individualized communications from a licensed provider, content available through the Sites is provided for general informational and educational purposes.
Site content is not:
- Medical advice;A diagnosis;
- A prescription;A substitute for professional medical judgment;
- A guarantee that a treatment is appropriate for you; or
- A substitute for emergency or in-person care.
Do not delay seeking medical care because of information displayed on the Sites.
Certain Services require account registration.
You agree to:
- Provide accurate, complete, and current information;
- Maintain and promptly update your information;
- Keep your username, password, and authentication credentials confidential;
- Use only your own account;
- Notify AmalfiDuo promptly of suspected unauthorized access; and
- Log out when using a shared or unsecured device.
You may not:
- Create an account using another person’s identity;
- Share your account or password;
- Maintain duplicate accounts to avoid restrictions;
- Access another person’s account; or
- Allow another person to submit medical information on your behalf unless legally authorized.
You are responsible for activity occurring through your account to the extent permitted by law.
AmalfiDuo may suspend access when it reasonably believes that information is inaccurate, an account has been compromised, Services are being misused, or suspension is necessary to protect a patient, provider, pharmacy, or platform.
Accessing the Sites through a modified, “jailbroken,” “rooted,” unsupported, or otherwise compromised device or browser may undermine security safeguards and expose health information.
You should not access the Sites through a device or browser known to be compromised.
AmalfiDuo may restrict access from devices, browsers, networks, or locations presenting a material security risk.
Subject to your compliance with these Terms, AmalfiDuo grants you a personal, limited, revocable, nonexclusive, and nontransferable right to access and use the Sites in the United States solely for your personal, noncommercial use.
No ownership interest in the Sites, software, content, or Services is transferred to you.
AmalfiDuo may restrict or suspend access where reasonably necessary to protect security, comply with law, prevent misuse, or enforce these Terms.
You may not attempt to:
- Impersonate another person or misrepresent your identity;
- Submit false, fraudulent, or misleading health information;
- Obtain medication for another person;
- Use the Services in violation of law;Interfere with another patient’s care;
- Gain unauthorized access to an account, system, or network;
- Introduce viruses, malware, or harmful code;
- Circumvent security, access, or verification controls;
- Reverse engineer, decompile, or disassemble platform software;
- Scrape, copy, monitor, or extract Site content using automated means without permission;
-Use Site content to build or train a competing product or service;
- Resell, transfer, or commercially exploit the Sites or Services;
- Infringe intellectual-property, privacy, or other rights;
- Harass, threaten, abuse, or exploit providers, staff, or other users; or
- Encourage another person to engage in prohibited conduct.
Personal information and health information you submit do not become the unrestricted property of AmalfiDuo.
Such information is collected, used, maintained, and disclosed only as described in the applicable Privacy Policy, Consumer Health Data Privacy Policy, Notice of Privacy Practices, consents, and applicable law.
You authorize AmalfiDuo and its authorized service providers to process information as reasonably necessary to:
- Provide the Services you request;
- Facilitate provider evaluation;
- Coordinate prescription and pharmacy services;
- Process payments;Provide support;
- Operate and secure the Sites;
- Comply with legal obligations; and
- Perform other purposes disclosed to you or authorized by you.
If you voluntarily provide suggestions or feedback that do not contain personal information or protected health information, AmalfiDuo may use that feedback without restriction or compensation to improve its services.
As between you and AmalfiDuo, AmalfiDuo or its licensors owns the Sites and their content, design, software, functionality, text, graphics, images, videos, logos, and other materials, except for content owned by third parties.
You may not reproduce, modify, distribute, publish, display, sell, license, create derivative works from, or commercially exploit Site content except as expressly permitted in writing or through ordinary Site functionality.
AmalfiDuo™, its logos, and related names, designs, and slogans are trademarks or service marks of BeMediq LLC or its licensors.
Other names and marks displayed on the Sites belong to their respective owners.
No license to use any trademark is granted except as expressly stated in writing.
The Sites may contain links to third-party websites or services, including provider, pharmacy, payment, laboratory, delivery, or informational resources.
AmalfiDuo does not control and is not responsible for the content, availability, security, privacy practices, products, or services of independent third parties.
A link does not necessarily indicate endorsement.
Your use of an independent third-party service is governed by that party’s terms and privacy policies.
If a licensed provider issues a prescription, it may be transmitted to a participating independent pharmacy or, where permitted and available, another pharmacy selected by you.
AmalfiDuo:
- Is not a pharmacy;
- Does not make dispensing decisions;
- Does not compound or manufacture medication;
- Does not control pharmacy operations;
- Does not provide pharmacy counseling; and
- Does not itself dispense, package, or ship medication.
The dispensing pharmacy is responsible for verifying and processing the prescription, preparing or compounding medication when applicable, labeling, dispensing, counseling, and shipment.
You authorize the disclosure of information reasonably necessary for the pharmacy to process and fulfill your prescription, including your identifying information, contact and shipping information, prescription, relevant medical information, and payment or order information.
The identity of the dispensing pharmacy will appear on your prescription label, pharmacy communications, or order records.
Some medications available through AmalfiDuo may be custom-compounded by a licensed pharmacy pursuant to an individual prescription.
Compounded medications are not FDA-approved. The FDA does not verify the safety, effectiveness, or quality of a compounded medication before it is marketed or dispensed.
A compounded medication is not the same as an FDA-approved generic drug and should not be represented as equivalent to an FDA-approved product.
A licensed provider may also prescribe an FDA-approved ingredient for a use, dosage form, population, or combination not included in its FDA-approved labeling when the provider determines that doing so is medically appropriate.
Your provider is responsible for explaining material information concerning the medication’s status, anticipated benefits, limitations, risks, and alternatives.
Actual medication appearance, formulation, strength, packaging, labeling, and dispensing pharmacy may differ from images or descriptions displayed on the Sites.
Use medication only as directed by your prescribing provider and pharmacy label.
You agree that you will:
- Not share medication with another person;
- Not use another person’s medication;
- Not increase the dose or frequency without provider approval;
- Not combine treatments without informing your provider;
- Review pharmacy-provided medication information;
- Follow storage and handling instructions;
- Keep medication away from children and pets; and
- Promptly report serious or unexpected side effects.
Medication images and product visuals are illustrative and may not reflect the exact medication, package, label, color, size, or dosage form dispensed.
The AmalfiDuo Medication Safety Information is incorporated into these Terms by reference.
You agree to pay all fees clearly disclosed before you submit an order or enroll in a treatment program.
When you provide payment information, you authorize AmalfiDuo, BeMediq LLC, its payment processor, and other authorized parties to:
- Verify your payment method;
- Place a temporary authorization hold;
- Charge amounts due if treatment is prescribed; and
- Charge future recurring orders when you have expressly enrolled in a recurring treatment program.
Unless otherwise clearly disclosed before checkout, your online medical review is included in the treatment program price, and you will not be charged if a provider does not prescribe treatment.
Entering payment information or receiving an authorization hold does not mean that treatment has been approved.
If treatment is prescribed, you authorize the charge shown at checkout, including applicable medical, medication, pharmacy, fulfillment, and shipping charges.
Some AmalfiDuo treatment programs include recurring medication shipments or refills.
Before enrollment, the checkout process will disclose:
- The amount charged;
- The billing frequency;
- What the charge includes;
- When the first charge will occur; and
- How to cancel or manage future renewals.
By enrolling, you authorize AmalfiDuo or its payment processor to charge your payment method at the disclosed interval until you cancel or the program ends.
Recurring charges require clear authorization, and consumers retain rights concerning automatic debits from their accounts.
Every refill remains subject to:
- Continued clinical appropriateness;
- Provider approval when required;
- Completion of requested follow-up;
- Current health and medication information;
- Valid payment information;Pharmacy availability; and
- Applicable law.
Enrollment does not guarantee that every refill will be prescribed or dispensed.
You may cancel future recurring orders through the available account controls or by contacting AmalfiDuo Support.
To prevent processing of the next order, a cancellation request must be received before the order has entered clinical or pharmacy processing.
Cancellation stops future renewals but does not automatically cancel:
- An order already approved;
- A prescription already transmitted;
- Medication already being compounded or prepared;
- Medication already dispensed or shipped; or
- Charges already properly incurred.
You may request to pause or delay future refills when that option is available. A pause may affect continuity of treatment.
Before treatment resumes, a provider may require:An updated health assessment;
- A follow-up consultation;
- Current blood-pressure information;
- Additional records; or
- Other clinically relevant information.
Do not pause, stop, restart, or change medication contrary to your provider’s instructions.
Because prescription medications are prepared or dispensed for an individual patient, they generally cannot be returned, resold, or reused.
Unless otherwise required by law or expressly stated in a separate refund policy:
- Charges are generally nonrefundable once a pharmacy begins preparing, compounding, or dispensing medication;
- Shipped medication cannot be returned for a refund;
- A cancellation does not refund an order already processed; and
- Fees for completed medical or administrative services may be nonrefundable.
Contact AmalfiDuo Support promptly if:
- You believe you were charged incorrectly;
- A package arrives damaged;
- The contents are missing;
- You receive the wrong medication;
- The shipment appears compromised; or
- A pharmacy or fulfillment error may have occurred.
Refunds, replacements, or credits will be considered based on the circumstances, pharmacy findings, applicable policies, and law.
Shipping dates and delivery estimates are not guaranteed.
Delays may occur because of:
- Provider review;Requests for additional information;
- Pharmacy preparation or compounding;
- Medication availability;Weather;
- Carrier delays;
- Holidays;
- Address errors; or
- Events outside AmalfiDuo’s control.
You are responsible for providing a complete and accurate shipping address and monitoring tracking information.
Do not use medication that appears damaged, tampered with, improperly stored, mislabeled, or different from what you expected. Contact the dispensing pharmacy or AmalfiDuo Support for instructions.
Unless expressly stated otherwise, AmalfiDuo Services are offered on a self-pay basis.
AmalfiDuo, Beluga Health, and participating providers and pharmacies generally do not submit claims to private insurance, Medicare, Medicaid, TRICARE, or another government healthcare program for Services purchased through AmalfiDuo.
You are responsible for understanding your insurance benefits and for all amounts charged through the Services.
No representation is made that an insurer or government program will reimburse you.
Additional self-pay and government-health-plan terms may be included in the Beluga Health Informed Consent for Telehealth Services and are incorporated by reference.
No particular result, benefit, response, or outcome is guaranteed.Individual results vary, and medication may not work as expected for every patient.
AmalfiDuo, Beluga Health, participating providers, and pharmacies do not guarantee the continued availability of:
- A particular treatment;
- A medication strength or dosage form;
- A provider;A pharmacy;
- A refill;
- A program price; or
- The Services generally.
Services or treatment programs may be modified or discontinued based on clinical, legal, regulatory, pharmacy, supply, or operational considerations.
When reasonably practicable, notice will be provided regarding material changes affecting an active recurring program.
These Terms remain effective while you access or use the Sites or Services.
You may terminate your use by discontinuing access and canceling any recurring program.
AmalfiDuo may suspend or terminate access when reasonably necessary, including for:
- Violation of these Terms;
- Fraud or misuse;
- Threatening or abusive conduct;
- Security concerns;False or misleading information;
- Failure to pay valid charges;
- Legal or regulatory requirements;
- Clinical or patient-safety concerns; or
- Discontinuation of the Services.
Termination of access to the Sites does not eliminate a provider’s or pharmacy’s independent legal and professional obligations concerning medical records, continuity of care, or completed transactions.
Sections that by their nature should survive termination will remain effective, including provisions concerning intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITES AND NONCLINICAL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
AmalfiDuo and BeMediq LLC disclaim warranties concerning the operation of the Sites, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
AmalfiDuo does not warrant that the Sites will be:
- Uninterrupted;
- Error-free;
- Completely secure;
- Available at all times;
- Free of malware or harmful code; or
- Compatible with every device or system.
This disclaimer applies to the technology and administrative services provided by AmalfiDuo. It does not alter the independent professional duties of a licensed healthcare provider or dispensing pharmacy.
Nothing in these Terms disclaims a warranty or duty that cannot legally be disclaimed.
To the maximum extent permitted by law, BeMediq LLC, AmalfiDuo, their affiliates, licensors, vendors, officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Sites or nonclinical Services.
This may include loss of data, revenue, profits, goodwill, use, or business opportunity; service interruption; device damage; or the cost of substitute services.
To the maximum extent permitted by law, AmalfiDuo’s aggregate liability arising from the Sites or nonclinical Services will not exceed the amount you paid to AmalfiDuo for the transaction or Services giving rise to the claim.
These limitations do not apply to:
- Liability that cannot legally be limited;
- Gross negligence or willful misconduct where exclusion is prohibited;
- The independent professional medical services of a healthcare provider; or
- The independent professional and dispensing obligations of a pharmacy.
Some jurisdictions do not permit certain exclusions or limitations, so portions of this section may not apply to you.
To the extent permitted by law, you agree to indemnify and hold harmless BeMediq LLC, AmalfiDuo, and their affiliates, officers, directors, employees, agents, licensors, and service providers from third-party claims arising from:
- Your fraudulent or unlawful use of the Sites;
- Your intentional submission of materially false information;
- Your unauthorized use of another person’s account;
- Your infringement of a third party’s rights;
- Your willful misconduct; or
- Your material breach of these Terms.
This obligation does not apply to claims caused by AmalfiDuo’s own negligence, misconduct, or violation of law to the extent such exclusion is prohibited.
AmalfiDuo may modify, suspend, or discontinue all or part of the Sites or Services.
Where reasonably practicable, notice will be provided before a material change affecting an active paid or recurring Service.
AmalfiDuo is not liable for a modification, suspension, or discontinuation except where applicable law or an express contractual commitment requires otherwise.
AmalfiDuo may update these Terms to reflect changes in:
- Services;
- Technology;
- Business practices;
- Providers or pharmacies;
- Payment arrangements;
- Laws or regulations; or
- Security and privacy practices.
The updated Terms will be posted with a revised effective date.
Where required, material changes will be communicated through email, the patient account, a website notice, or another appropriate method.
Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law. When affirmative consent is legally required, it will be requested separately.
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT.
These Terms and your use of the Sites are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Except for claims eligible for small-claims court, claims concerning intellectual-property rights, or requests for temporary or preliminary injunctive relief, disputes arising from these Terms or the Sites will be resolved through final and binding individual arbitration administered by the American Arbitration Association under its applicable consumer rules.
Unless otherwise required by applicable law or agreed by the parties, arbitration will take place in Austin, Texas, or remotely.
For disputes that are not subject to arbitration, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Travis County, Texas.
Nothing in this section prevents either party from reporting concerns to a federal, state, or local regulatory agency.
This section should be reviewed by BeMediq LLC’s attorney before publication, particularly if BeMediq LLC is organized outside Texas or prefers a different arbitration venue.
If a provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted and replaced, where appropriate, by a valid provision that most closely reflects its intended purpose.
The remaining provisions will continue in effect.
Headings are provided for convenience and do not affect interpretation.
Failure by AmalfiDuo to enforce a provision of these Terms does not waive the right to enforce that or another provision later.
A waiver is effective only if made in writing by an authorized representative of BeMediq LLC.
These Terms do not create a partnership, joint venture, employment, franchise, fiduciary, or agency relationship between you and BeMediq LLC.
You may not enter into an agreement or obligation on behalf of AmalfiDuo or BeMediq LLC.
Independent healthcare providers and pharmacies are not employees or agents of AmalfiDuo solely because patients access their services through the Sites.
You may not assign your rights or obligations under these Terms without written consent from BeMediq LLC.
BeMediq LLC may assign these Terms in connection with a merger, acquisition, restructuring, financing, sale of assets, or transfer of the AmalfiDuo business, subject to applicable privacy, healthcare, and consumer-protection laws.
AmalfiDuo respects intellectual-property rights and may remove content that it reasonably believes infringes another person’s copyright.
A notice of claimed copyright infringement should include:
- A physical or electronic signature of the authorized copyright owner or representative;
- Identification of the copyrighted work;
- Identification and location of the allegedly infringing material;
- Contact information for the complaining party;
- A statement of good-faith belief that the disputed use is unauthorized; and
- A statement, made under penalty of perjury, that the notice is accurate and that the complaining party is authorized to act.

- Applicable Notice of Privacy Practices;

- Compounded or off-label medication consents;
- Payment and recurring-refill authorizations; and
- Other consents presented during intake or checkout.
A separate clinical, pharmacy, payment, or privacy consent controls over these Terms with respect to the specific subject it addresses.
